Federal Judge Orders Freedom of Abrego Garcia from Immigration Detention
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks legal authority.
"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.
The case originates in a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to answer human smuggling allegations, he was held in federal custody.
In her decision, the judge noted that the government does not have a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
