Michael Jordan Tells Court He Felt No Fear of Nascar in Legal Battle
The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, stated that his competitive side and novelty within the sport motivated his push for 23XI Racing to confront Nascar over alleged violations of competition laws.
Financial Stakes and a Will to Win
Jordan shared operational insights of his 23XI team, revealing he invested $40 million of his personal wealth into the Nascar Cup series team co-founded with partner Polk and driver Hamlin.
“Someone had to step forward,” Jordan stated in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I felt I could challenge Nascar as a whole. From my perspective, the sport it needed to be looked at through a new lens.”
Central Issue: Franchise System and Renewal Demands
At issue is the expiration of a 2016 deal where Nascar provided each team a “charter”. The concept is similar to other major leagues with separately owned franchises, such as the NBA’s Hornets or the Carolina Panthers. The agreement was set to expire in 2024 when Nascar insisted on teams renew their charters.
Jordan was on the witness stand for about sixty minutes and left the court to a media frenzy, with onlookers and reporters vying for a view or a picture of the sports legend.
Spearheading the Fight
Jordan’s 23XI is at the forefront of the push along with Front Row Motorsports for Nascar to change a business model Jordan said is unlawful to maintain excessive control.
At issue for Jordan and Heather Gibbs, who preceded Jordan, are details from last September. She recounted a frantic and emotional period where the sanctioning body informed teams they had to sign a contract extension. The document consists of over a hundred pages outlining pay for chartered teams and a guaranteed spot in Nascar-sponsored races.
A Refusal to Sign
Jordan said that his team and its ally decided their only feasible option was to refuse a signature that 112-page package and take the issue to court. All other teams agreed to the terms.
The team owners reached out to Nascar about potential amendments or negotiations. Nascar refused to engage, Jordan said.
The Bottom Line: Winning
Ultimately, the resistance against what he saw as a unsustainable system was mostly about the usual bottom line for Jordan: Success.
“Denny convinced me adding a third car improved our chances to win,” he testified, sharing that he bought a third charter late in 2024 for $28 million despite the uncertainty. “So I took the plunge.”
Account from the Gibbs Family
Gibbs described her push for indefinite franchises, submitted in a written letter to Nascar. She testified the pressure of the contract signing demand was problematic.
According to her, the team founder first attempted to call and persuade Nascar against forcing signatures, but CEO Jim France declined the request.
“Don’t do this to us,” Heather Gibbs said Joe Gibbs told Nascar’s leadership. She said France replied, “If I wake up and I have 20 charters, I have 20. If I have 30, that’s the number.”
